This Privacy Policy describes how Klay The Label, LLC, a Delaware limited liability company (“Klay The Label,” “we,” “us,” or “our”), collects, uses, and shares personal information when you visit or make a purchase from https://www.klaythelabel.com (the “Site”), interact with our marketing, or otherwise communicate with us (collectively, the “Services”).

Please read this Privacy Policy carefully. By using the Services, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with our practices, please do not use the Services.

2. INFORMATION WE COLLECT

The personal information we collect depends on how you interact with the Services. We collect the following categories of information.

Information you provide to us

- Contact details, such as your name, email address, phone number, and shipping and billing addresses.
- Order information, such as the products you purchase, order history, and payment confirmation. Payment card details are collected and processed directly by our payment processors; we do not store full card numbers.
- Account information, such as your username, password, and saved preferences if you create a customer account.
- Communications, such as the contents of messages you send us through email, contact forms, chat, or social media, including any attachments.
- Marketing preferences, such as whether you have opted in to email or SMS marketing.
- Any other information you choose to provide, such as product reviews, survey responses, or contest entries.

Information we collect automatically

When you use the Site, we and our service providers automatically collect certain information about your device and how you interact with the Services (“Usage Data”), including:

- Device and browser information, such as IP address, browser type, operating system, device identifiers, language, and time zone.
- Interaction data, such as the pages you view, products you look at or add to your cart, referring and exit pages, links clicked, and the date and time of your visit.
- Approximate location derived from your IP address.

We collect Usage Data using cookies, pixels, web beacons, and similar technologies. See Section 4 for more information.

Information we receive from third parties

We may receive information about you from third parties, including:

- Shopify, which hosts our store and processes orders on our behalf.
- Payment processors, such as Shopify Payments, Shop Pay, PayPal, and similar providers, who share confirmation of payment and fraud-prevention signals.
- Shipping and fulfillment partners, who share delivery status.
- Advertising and analytics partners, such as Meta and Google, who share information about how you interacted with our ads.
- Social media platforms, if you interact with us or tag us on those platforms.

3. HOW WE USE YOUR INFORMATION

We use personal information for the following purposes:

- To provide the Services, including processing payments, fulfilling and shipping orders, managing returns and exchanges, sending order confirmations and shipping updates, and maintaining your account.
- To communicate with you, including responding to your questions and requests and providing customer support.
- For marketing and advertising, including sending you promotional emails or text messages (where you have opted in or where otherwise permitted by law), showing you ads on other websites and platforms, and measuring the effectiveness of our campaigns.
- To improve the Services, including understanding how customers use the Site, testing new features, and developing new products.
- For security and fraud prevention, including detecting and preventing fraudulent transactions, unauthorized access, and other harmful activity.
- To comply with legal obligations, including tax, accounting, and consumer-protection requirements, and to enforce our Terms of Service and other agreements.

4. COOKIES AND TRACKING TECHNOLOGIES

We use cookies and similar technologies on the Site. Cookies are small data files placed on your device. We use the following categories:

- Strictly necessary cookies, which are required to operate the Site, such as keeping items in your cart and processing checkout. These are set by Shopify and cannot be turned off.
- Analytics and performance cookies, which help us understand how visitors use the Site. We use Shopify Analytics and Google Analytics for this purpose.
- Advertising cookies and pixels, which allow us and our advertising partners to show you relevant ads on other websites and platforms and to measure ad performance. We use the Meta Pixel (Facebook and Instagram) and Google Ads tags for this purpose.
- Marketing cookies, which allow our email and SMS platform to recognize you when you return to the Site and to send you abandoned-cart and other personalized messages.

You can control cookies through your browser settings, although disabling certain cookies may affect the functionality of the Site. You can also opt out of interest-based advertising through the following:

We do not currently respond to browser “Do Not Track” signals. We do honor Global Privacy Control (GPC) signals as an opt-out of sale or sharing where required by law.

5. HOW WE SHARE YOUR INFORMATION

We share personal information with the following categories of recipients:

- Service providers who help us operate our business, including Shopify (e-commerce platform and hosting), payment processors, shipping carriers and fulfillment partners, email and SMS marketing platforms, customer support tools, and analytics providers. These providers are permitted to use your information only to perform services for us.
- Advertising partners, including Meta and Google, with whom we share Usage Data and, in some cases, hashed contact information so they can show you our ads and measure their performance. Under certain laws, including California law, this may be considered a “sale” or “sharing” of personal information. See Section 10 for how to opt out.
- Business transfers, if we are involved in a merger, acquisition, financing, reorganization, or sale of all or part of our business, in which case personal information may be transferred to the acquiring entity.
- Legal and safety purposes, when we believe disclosure is required by law, regulation, legal process, or governmental request, or is necessary to protect the rights, property, or safety of Klay The Label, our customers, or others.
- With your consent or at your direction.

We do not sell personal information for money.

6. MARKETING COMMUNICATIONS

Email. If you have opted in to marketing emails, you can unsubscribe at any time by clicking the “unsubscribe” link in any marketing email or by contacting us at hello@klaythelabel.com. We will continue to send you transactional emails, such as order confirmations and shipping updates, which are necessary to fulfill your order.

Text messages (SMS). If you have opted in to receive text messages, you can opt out at any time by replying STOP to any message. Message and data rates may apply. Consent to receive marketing text messages is not a condition of purchase.

7. DATA RETENTION

We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, including to provide the Services, comply with our legal obligations (such as tax and accounting rules, which generally require us to keep order records for up to seven years), resolve disputes, and enforce our agreements. When personal information is no longer needed, we delete or anonymize it. Because our store is hosted on Shopify, retention of certain data is also subject to Shopify's data practices.

8. SECURITY

We use reasonable technical and organizational measures designed to protect personal information, including encryption of payment data in transit and the security controls provided by Shopify's PCI DSS-compliant platform. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account password confidential.

9. INTERNATIONAL TRANSFERS

We are based in the United States, and our service providers may be located in the United States or other countries. If you are located outside the United States, your personal information will be transferred to and processed in the United States and other jurisdictions that may not provide the same level of data protection as your home country. Where required by law, we rely on appropriate safeguards for such transfers, such as the European Commission's Standard Contractual Clauses, the UK International Data Transfer Addendum, or the EU-U.S. Data Privacy Framework where our providers are certified.

10. YOUR PRIVACY RIGHTS

Depending on where you live, you may have some or all of the following rights regarding your personal information:

- Access: to request a copy of the personal information we hold about you.
- Correction: to request that we correct inaccurate or incomplete information.
- Deletion: to request that we delete your personal information, subject to certain exceptions.
- Portability: to receive your personal information in a structured, commonly used, machine-readable format.
- Opt out of marketing: to unsubscribe from marketing emails or text messages at any time.
- Opt out of targeted advertising and sale or sharing: to opt out of our sharing of your information with advertising partners for targeted advertising.
- Restriction and objection: to restrict or object to certain processing of your personal information.
- Withdraw consent: where we rely on your consent, to withdraw it at any time.
- Non-discrimination: we will not discriminate against you for exercising any of these rights.

To exercise any of these rights, email us at hello@klaythelabel.com with the subject line “Privacy Request.” To opt out of targeted advertising, you can also email us or use the cookie controls and industry opt-out tools described in Section 4. We may need to verify your identity before responding, and we may ask for additional information for that purpose. You may designate an authorized agent to make a request on your behalf, provided the agent can demonstrate authority to act for you. We will respond within the time required by applicable law.

Residents of the European Economic Area, United Kingdom, and Switzerland

If you are located in the EEA, UK, or Switzerland, we process your personal information on the following legal bases:

- Performance of a contract, to process and deliver your order and provide customer support.
- Consent, for marketing emails and text messages and for non-essential cookies, which you may withdraw at any time.
- Legitimate interests, for analytics, fraud prevention, security, and improving the Services, where those interests are not overridden by your rights.
- Legal obligation, for tax, accounting, and regulatory compliance.

You have the rights listed above, including the right to lodge a complaint with your local data protection authority. In the UK, this is the Information Commissioner's Office (https://ico.org.uk). We will respond to requests within one month, which may be extended by two further months where requests are complex or numerous. We do not charge a fee for responding to requests unless a request is manifestly unfounded or excessive.

California residents

This section applies to California residents under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA”).

In the preceding 12 months, we have collected the following categories of personal information as defined by the CCPA: identifiers (such as name, email, phone, address, and IP address); customer records (such as billing and shipping details); commercial information (such as purchase history); internet or network activity (such as browsing and interaction data); approximate geolocation (derived from IP address); and inferences drawn from the above. We collect this information from the sources and for the purposes described in Sections 2 and 3, and we share it with the categories of recipients described in Section 5.

We do not sell personal information for money. However, our use of advertising cookies and pixels, and our sharing of Usage Data and hashed contact information with advertising partners such as Meta and Google, may be considered “sharing” for cross-context behavioral advertising, and in some cases a “sale,” under the CCPA. The categories shared for this purpose are identifiers, internet or network activity, and commercial information. You can opt out by emailing hello@klaythelabel.com with the subject line “Do Not Sell or Share My Personal Information,” by enabling a Global Privacy Control signal in your browser, or by using the opt-out tools in Section 4. We do not knowingly sell or share the personal information of consumers under 16 years of age. We do not use or disclose sensitive personal information for purposes other than those permitted by the CCPA.

California residents have the right to know, delete, correct, opt out of sale or sharing, limit the use of sensitive personal information, and not be discriminated against for exercising these rights. We will confirm receipt of a request within 10 business days and respond within 45 calendar days, which may be extended by an additional 45 days where reasonably necessary.

Residents of other US states

If you reside in a state with a comprehensive privacy law (including Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana, and others), you may have similar rights to access, correct, delete, and obtain a copy of your personal information, and to opt out of targeted advertising, sale of personal information, and certain profiling. You may exercise these rights using the contact information above. If we deny your request, you may appeal by replying to our response with the word “Appeal.”

Canadian residents

If you are located in Canada, we collect, use, and disclose your personal information with your consent or as otherwise permitted by the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws. You may withdraw consent, subject to legal and contractual restrictions, and you have the right to access and correct your personal information. Your information may be stored and processed outside Canada, including in the United States, and may be subject to the laws of those jurisdictions. You may direct complaints to us or to the Office of the Privacy Commissioner of Canada.

Australian residents

If you are located in Australia, we handle your personal information in accordance with the Australian Privacy Principles under the Privacy Act 1988 (Cth). You may request access to or correction of your personal information, and you may complain to us about a breach of the Australian Privacy Principles. If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner (https://www.oaic.gov.au). Your personal information may be disclosed to recipients located in the United States and other countries where our service providers operate.

11. CHILDREN

The Services are not directed to children, and we do not knowingly collect personal information from anyone under 16 years of age. If you are a parent or guardian and believe your child has provided us with personal information, please contact us at hello@klaythelabel.com and we will delete it.

12. THIRD-PARTY LINKS AND SERVICES

The Site may contain links to third-party websites, social media platforms, and services, including payment providers and shipping carriers. This Privacy Policy does not apply to those third parties, and we are not responsible for their privacy practices. We encourage you to review the privacy policies of any third-party service you use. Our store is hosted on Shopify; you can learn how Shopify handles personal information at https://www.shopify.com/legal/privacy.

13. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy from time to time to reflect changes to our practices or for legal, operational, or regulatory reasons. We will post the updated policy on the Site and revise the “Last updated” date above. Where required by law, we will notify you of material changes.
